Himachal High Court held appointment of 480 teachers illegal

Himachal High court on Friday termed the recruitments made under the Himachal Pradesh Higher Education Department (Post Graduate Teacher, Class-III (Non-Gazetted) Recruitment and promotion (1st Amendment) Rules 2011, as illegal and ordered termination of 480 teachers within four weeks.
Himachal High Court Justice Rajiv Sharma directed the state government to issue notices to all the persons appointed under the rule and terminate their services with in a period of four weeks.
While filing reply to a petition that has challenged the recruitment, the Director Higher Education has informed the High Court that the state government had filled 220 posts of teachers by way of direct recruitment and 260 by way of promotion under these Rules, 2011 and these rules are not still published in Rajpatra.
Justice Rajiv Verma passed the order of termination of services of teachers on a petition challenging these Rules on the ground that till date the same were not published in Rajpatra.
It was further alleged that Rules, 2011 were notified on August 19, 2011 and these were to come into force from the date of its publication in the Rajpatra (Government’s official gazette).
While quashing the same, the court observed that “the appointments made under these Rules, which have been not published are illegal.”
However, the court had given liberty to the state to fill up the posts in future strictly in accordance with the rules after their publications in the official gazette.
