HC asks state to reply on appointments of TGT's on TET merit

The High Court of Himachal Pradesh today directed the State
Government to file short reply as to how the selection to the post of
TGT is permissible otherwise than as per the R&P, Rules & without
following the normal mode of selection, with in two weeks. The Court
has stayed the notification of the Department of Elementary Education
dated 27.06.2012 . The Court also made it clear that until further
orders, there shall be no appointment to any post of TGT, medical, non
medical & Arts etc. otherwise than in accordance with R&P Rules.
The Division Bench comprising Chief Justice Kurian Joseph and
Justice D.C Chaudhary passed these orders on the petition filed by one
Digvijay Patyal who challenged the notification of the Department of
Elementary Education dated 27.06.2012 wherein it is provided that in
relaxation to the recruitment process the posts of TGT in various
disciplines (Arts, Non Medical & Medical) are to be filled on the
basis of merit of Teacher Eligibility Test (TET). The petitioner has
alleged in the petition that the State is not giving appointment as
per the rules/norms existing during the commencing of the selection
process and offering appointment only on basis of merit of eligibility
test and not following the procedure as laid down in the recruitment &
promotion rules.  The petitioner has prayed in the petition to issue
direction to the State Government to hold a regular test as provided
in “Himachal Pradesh, Elementary Education Department, and Trained
Graduate Teacher, Class-III (Non-Gazetted) Recruitment & Promotion
Rules, 2009 for the recruitment of TGTs in various disciplines as was
followed during normal course of appointment in the past.
