It would also be mandatory for the shops and other commercial establishment in the state to follow the labour laws and other rules strictly. With this objective Himachal Pradesh Shops and Commercial Establishment (Amendment) Bill, 2012 was introduced in the state assembly here on Monday by the Industries and Labour Minister, Kishan Kapoor.
This bill aims at regulation of working conditions of workers and employment in shops, intervals of their meals, opening hours, maternity benefits and others. The bill also has a provision of enhanced penalties for the contravention of the provision of Act.
If the bill is passed by the assembly a fine of minimum of Rs. 1000 to Rs. 5000 can be imposed on the shop owners and other establishments. Further the fine can be extended to minimum three thousand to eight thousand rupees for the second offence.
It has been experienced that there was gross violations of the provision of the act by the employer of the establishments for the reason that the penalty provided for such violation was very nominal and had no deterrent effect.
The amendment bill will also provide powers to officers of the rank of Assistant Chief Inspector and above to compound an offense under the act.
Along with this bill, the Himachal Pradesh Passengers and Good Taxation (Amendment ) Bill, 2012 and Himachal Pradesh Taxation ( On Certain Goods Carried by Road) Amendment Bill, 2012 were also tabled in the house.
